6 Months And 6 Thousand Kilometers Requirement For The Sale Of Second-Hand Cars And Off-Road Vehicles

Amendment of the Regulation on the Sale of Second-Hand Motor Vehicles of the Ministry of Commerce

The Ministry of Commerce has amended the Regulation on the Trade of Second-Hand Motor Land Vehicles by making an important regulation on the sale of second-hand motor land vehicles. The amendment to the Regulation was published in the Official Gazette on 16 August 2022 and includes the addition of a temporary article to the Regulation on the Trade of Second-Hand Motor Land Vehicles published in the Official Gazette dated 13/2/2018 and numbered 30331.

In this context, the following important points have been determined under the heading of "Marketing and Sales Restriction":

  • Persons engaged in the trade of second-hand motor vehicles cannot directly or indirectly sell vehicles registered in their names until July 1, 2023, unless six months and six thousand kilometers have passed from the date of first registration,

  • It is regulated that the Ministry has the authority to extend this date for up to six months.

However, with the amendment, persons engaged in the trade of second-hand motor vehicles are provided with the opportunity to sell their vehicles registered in their names until September 15, 2022.

  • It is stated that if the vehicles in question are not sold by September 15, 2022, the marketing and sale of these vehicles cannot be carried out unless six months and six thousand kilometers have passed from the date of first registration.

The 6 months and 6 thousand km conditions determined in the regulation do not cover individual sales. With these changes, the regulations in the sector have been updated and steps have been taken to conduct trade in a more transparent and fair manner.
